through Adverse Possession

In a case that spans over two decades, Hunt Law, PLLC won for their Plaintiff client exclusive ownership of their residence located at Charlotte, NC against a co-tenant, following a civil trial for Declaratory Judgment pursuant to N.C.G.S. § 1-254 et. seq. The court's decision affirms their client’s claim of adverse possession, acknowledging their sole and exclusive possession of the property since November 1998.


The legal saga began when Plaintiff purchased the residence with the co-tenant Defendant in September 1998 as "tenants-in-common." However, circumstances took a dramatic turn as Defendant relinquished possession of the residence to Plaintiff and failed assert their right as a co-tenant for more than a twenty-year period.

 

For over twenty years, Plaintiff maintained sole and exclusive possession of the residence. They shouldered the responsibility of paying taxes, insurance, and the mortgage associated with the property. Notably, Plaintiff undertook major maintenance tasks, such as replacing the roof and hot water heater, without any involvement or permission from Defendant. Importantly, the court considered Plaintiff's unwavering dedication to the property, their financial contributions, and the absence of any acknowledgment of Defendant's “co-tenant” ownership during the relevant 20-year period.
